Terms of Service and Subscription Agreement

Effective Date: September 1, 2025

 

Agreement Between:

Service Provider: Lehigh Valley Home Maintenance LLC, 117 W Frankford St., Bethlehem, PA 18018. Contact: 610-417-5441 | Lvhomes4@gmail.com.

 

This Terms of Service and Subscription Agreement outlines the terms under which Lehigh Valley Home Maintenance LLC provides quarterly home maintenance subscription services to the Customer. By signing or accepting this Agreement electronically, You agree to be bound by its terms. If You do not agree, do not sign or use our services.

 

1. Services Provided (Scope of Work)

The Company will provide preventive home maintenance services on a quarterly basis (every 3 months) for the property located at [Insert Property Address]. Services include, but are not limited to:

 

Inspection and cleaning of HVAC systems (filters, vents, and coils).

Plumbing checks (leaks, drains, and fixtures).

Electrical system review (outlets, wiring, and safety devices).

Exterior and interior visual inspections (roof, gutters, siding, and structural integrity).

Minor repairs up to $100 per visit] (e.g., caulking, tightening fixtures).

 

Frequency: One (1) on-site visit per quarter, scheduled at mutually agreed times. 

Exclusions: This Agreement does not cover major repairs, emergencies, pest control, landscaping, appliance repairs beyond basic maintenance, or damage caused by misuse, neglect, or acts of God. Such services require a separate agreement and may incur additional fees.

 

All services will be performed by licensed, insured technicians in a professional manner, using industry-standard tools and complying with local building codes.

2. Subscription Term and Renewal
  • Yearly Subscription Commitment: This Agreement requires a one-year subscription commitment, commencing on the Effective Date, with services provided quarterly (every 3 months) as outlined in Section 1.

  • Billing Schedule: The yearly subscription fee is billed in four equal quarterly installments, as detailed in Section 3.

  • Renewal: The Agreement automatically renews for successive one-year terms, each billed quarterly, unless either party provides written notice of non-renewal at least 30 days before the end of the current term.

  • Quarterly Schedule: Services commence within 30 days of the first quarterly payment. Subsequent quarters align with the calendar (e.g., January-March, April-June, July-September, October-December).

 

3. Payment Terms
  • Subscription Fee: The yearly subscription fee is billed quarterly at $199.00 per quarter for properties up to 2,000 square feet, $299.00 per quarter for properties at or above 3,000 square feet, or $399.00 per quarter for properties at or above 5,000 square feet. Payments are due in advance on the 1st of each quarter (e.g., January 1, April 1, July 1, October 1).

  • Yearly Commitment: By signing this Agreement, You commit to a full year of service (four quarterly payments). Early cancellation within the yearly term is subject to Section 5.

  • Payment Method: Automatic charge to the credit card on file or [Insert Other Methods, e.g., ACH bank transfer]. You authorize the Company to charge the quarterly amount until termination.

  • Late Payments: Unpaid balances after 30 days may result in suspension of services and referral to collections.

  • Taxes: The fee excludes applicable sales/use taxes, which You agree to pay.

  • Fee Adjustments: The Company may adjust fees upon renewal with 60 days’ written notice, not to exceed 5% annually

4. Customer Responsibilities

Provide safe, unobstructed access to the property during scheduled visits.

Notify the Company in advance of any hazards (e.g., pets, security systems).

Maintain the property in reasonable condition between visits.

Pay for any additional services or materials requested beyond the scope.

Keep payment information current.

 

Failure to comply may result in rescheduling fees or termination.

 

5. Cancellation and Refund Policy (Return Policy for Services)

This section outlines how You may cancel the subscription and seek refunds ("Returns" for services). Services are non-refundable once performed, but we aim for fair resolution.

 

Cancellation by Customer:

 

During Initial Term: You may cancel with 30 days' written notice (email or certified mail to [Insert Contact]). No refunds for completed quarters. Prorated refund for unused portion of the current quarter (e.g., if canceled mid-quarter, refund 50% minus a $100.00 administrative fee).

After Initial Term: Cancel at any time with 30 days' notice before the next renewal. No further payments after notice period.

Early Cancellation Penalty: If canceled within the first 6 months, a $100 early termination fee applies to cover setup costs.

Cancellation by Company: We may terminate for non-payment, breach of terms, or if services become unsafe/impractical. We will provide 15 days' notice (except for non-payment, which is immediate). You will receive a prorated refund for unused services.

Refunds:

 

Processed within 10-14 business days via original payment method.

No refunds for completed services or if cancellation is due to Your breach.

Dissatisfaction Guarantee: If unsatisfied with a quarterly visit, notify us within 7 days for a one-time credit toward the next quarter (up to 50% of fee). Proof of issue required (e.g., photos).

No cash refunds; credits applied to future services.
 

Disputes: Refunds are at the Company's discretion. Contact [Insert Support Email/Phone] for assistance.

 

6. Warranties and Limitations

 

Company Warranty: Services are warranted for 30 days against defects in workmanship. We will re-perform defective work at no extra cost. No other warranties, express or implied.

Limitation of Liability: The Company's total liability is limited to the fees paid in the prior 12 months. We are not liable for indirect damages (e.g., property loss, consequential harm). You waive claims for services not explicitly listed.

Insurance: The Company maintains general liability insurance. You agree to maintain homeowner's insurance covering the property.

 

7. Termination

 

For Cause: Immediate termination for material breach (e.g., non-payment, property damage by You).

Effects of Termination: Outstanding payments due immediately. No further services provided. Accrued obligations survive termination.

 

8. Governing Law and Dispute Resolution

This Agreement is governed by the laws of Pennsylvania. Any disputes will be resolved first through good-faith mediation, then in Northampton County] courts. You agree to arbitration for claims under $10,000 via [Insert Service, e.g., AAA].

 

9. Miscellaneous

 

Entire Agreement: This document is the full agreement; no oral modifications.

Severability: Invalid provisions do not affect the rest.

Force Major: Delays due to unforeseen events (e.g., weather) excused.

Notices: Sent via email or mail to addresses above.
